TERMS OF USE

  1. GENERAL
    By accessing the Partner Portal of BRUSA HyPower AG and BRUSA Technology AG (hereinafter jointly referred to as BRUSA) and their links on the Internet, the user declares that he/she has understood and accepts the following legal information and terms of use. Any terms and conditions of the user that conflict with or deviate from these terms and conditions of use shall not apply.
    In addition, BRUSA reserves the right to amend these Terms of Use at any time in the future, e.g. to take account of changes in the law, changes to the services or regulatory loopholes.
  2. PROVISION OF SERVICES
    The mere provision of content by BRUSA free of charge does not create a contractual relationship between the user and BRUSA.
    BRUSA endeavours to ensure proper operation of the Partner Portal, but does not guarantee uninterrupted accessibility and usability of the Partner Portal.
    BRUSA therefore accepts no responsibility and gives no guarantee that the functions on the Partner Portal will be error-free and/or available at all times, that errors will be corrected or that the Partner Portal or the respective server is free of harmful components (in particular viruses).
  3. NO OFFER / NO CONSULTATION
    The content provided on the Partner Portal is for information purposes only. It does not constitute an invitation, offer or recommendation for the user to buy or sell products or to engage in any other transactions.
    No advice is given by BRUSA and the content provided does not constitute a decision-making aid for legal, tax or other advisory questions.
  4. CONTENT RIGHTS / COPYRIGHTS
    The entire content (texts, tables, graphics, images, videos, logos, etc.) of the Partner Portal is protected by copyright (all rights reserved) and is the property of BRUSA.
    Downloading or printing out content from the Partner Portal does not transfer any rights.
    The complete or partial reproduction, duplication or any other use or exploitation of Partner Portal content, in any form whatsoever, is not permitted without BRUSA's consent.
  5. LIMITATIONS OF LIABILITY, INDEMNITY AND WARRANTY
    BRUSA does not guarantee the accuracy, completeness and up-to-dateness of the content provided within the framework of the Partner Portal and the associated services.
    In no event shall BRUSA be liable for any loss and/or damage of any kind, including any direct or indirect consequential damages, arising out of or in connection with access to the Partner Portal and/or use of the content provided.
  6. DATA PROTECTION
    The Swiss Data Protection Act, the Swiss Data Protection Ordinance and BRUSA's privacy policy available at www.brusahypower.com and www.brusatechnology.com apply.
  7. APPLICABLE LAW, PLACE OF JURISDICTION
    The law of the Swiss Confederation shall apply.
    The exclusive place of jurisdiction is the registered office of BRUSA.
  8. FINAL TERMS
    Should individual provisions of these Terms of Use be invalid in whole or in part, this shall not affect the remaining provisions (severability clause).
    The current terms of use at the time of use are valid. BRUSA reserves the right to adjust the terms of use (see General).
